Court strikes down Arizona 20-week abortion ban

A federal court in San Francisco Tuesday struck down Arizona's ban on abortions after 20 weeks of pregnancy.

The 9th U.S. Circuit Court of Appeals ruled that the law violates a string of U.S. Supreme Court rulings starting with Roe v. Wade that guarantees a woman's right to an abortion before a fetus is able to survive outside the womb. That's generally considered to be about 24 weeks. Normal pregnancies run about 40 weeks

Several states have enacted similar bans starting at 20 weeks. But the 9th Circuit's ruling is binding only in the nine Western states under the court's jurisdiction. Idaho is the only other state in the region covered by the 9th Circuit with a similar ban.

A trial judge had ruled that the ban could take effect. U.S. District Judge James Teilborg ruled it was constitutional, partly because of concerns about the health of women and possible pain for fetuses.

But abortion-rights groups appealed that decision, saying the 20-week ban would not give some women time to carefully decide whether to abort problem pregnancies.


High court overturns Seattle drug arrest

The state Supreme Court on Thursday overturned the conviction of a man who was arrested on drug charges because the officer who saw the alleged crime was not the arresting officer.

Under state law, unless a specific statutory exception applies, only an officer who is present during the offense may arrest a suspect for a misdemeanor or a gross misdemeanor. Exemptions include traffic infractions where an officer can ask another to arrest the driver.

Gregorio Ortega was arrested in March 2009 in Seattle after an officer on the second floor of a building observed Ortega and another man purportedly appear to make three drug transactions. The officer in the building maintained radio contact with officers in a car nearby, described Ortega's activities and instructed them to arrest him. The officers found crack cocaine and cash on him, the court wrote.

In a unanimous ruling, the court reversed a Court of Appeals ruling in 2011 that upheld his 2009 conviction of possession of cocaine with intent to deliver, because it said the circumstances of his arrest went against state law.


Ex-Mass. chemist pleads not guilty to obstruction

A former Massachusetts chemist accused of faking test results at a state drug lab has pleaded not guilty to four counts of obstruction of justice in a scandal that could jeopardize thousands of drug convictions.

Annie Dookhan was indicted on a total of 27 charges accusing her of fabricating test results and tampering with drug evidence while testing substances in criminal cases.

The 35-year-old Dookhan was arraigned Wednesday on four obstruction counts in Brockton Superior Court. She was scheduled to be arraigned later Wednesday on additional charges in Fall River Superior Court.

An estimated 200 convicted defendants have been released from jail and had their cases put on hold while their legal challenges are pending.

Authorities shut down the lab in August.


Court date postponed in Hines Ward extortion case

A preliminary hearing for a man charged with trying to extort $15,000 from former Pittsburgh Steelers wide receiver Hines Ward was postponed Tuesday until Dec. 3 at the request of his attorney.

Defense attorney David Shrager said he needed more time to investigate the charges against Joshua Van Auker, 26, of Pittsburgh, along with the evidence. He struck a conciliatory tone when he addressed reporters after a brief court appearance, describing his client as naive and inexperienced.

"This is surreal for him, this is a nice young man," Shrager said of his client, who is accused of contacting Ward's personal assistant last week and threatening to go public with information that Ward had paid prostitutes for sex.
