Strict new Neb. abortion law faces long legal road

pIt's been called a groundbreaking law, but a measure approved in Nebraska last week that changes the rationale for abortion bans probably won't go into effect anytime soon — if ever./ppInstead, abortion opponents are hoping it will become the most important case on abortion to reach the U.S. Supreme Court in recent memory. Even they acknowledge the ban on abortions at and after 20 weeks of pregnancy won't see the light of day unless the high court rules that it is constitutional./ppMary Spaulding Balch, legislative director for National Right to Life, said a court injunction will likely prevent the implementation of the law. The measure passed last week by Nebraska's nonpartisan Legislature and signed into law by Republican Gov. Dave Heineman is scheduled to take effect in October./ppLower courts have no precedent to support the law, which bases the new restrictions on the assertion that fetuses feel pain./p


Lindquist Vennum law firm ousts partner for misconduct

pMichael S. Margulies, a prominent Twin Cities real estate lawyer and recently resigned member of the St. Paul Planning Commission, was forced to withdraw as partner of Minneapolis law firm Lindquist amp; Vennum after the firm claimed he engaged in professional misconduct. /ppThe firm's investigation uncovered the fact that (Margulies) had misappropriated significant sums from a limited number of clients and from the firm, said Daryle Uphoff, managing partner of Lindquist amp; Vennum, in a written statement. /ppThe statement came Friday, the same day Margulies, 56, of St. Paul, and his personal company, Triad Services, were sued in Ramsey County District Court by a real estate development company for which he had worked as an attorney, secretary and treasurer. /ppIn the lawsuit, CMB Minnetonka LLC alleged that Margulies made numerous illicit withdrawals from CMB's bank account and line of credit at Highland Bank and used the money — $1.5 million or more — for his own purposes. /ppSpecifically, the suit claims Margulies spent the money to overhaul the historic mansion at 516 Summit Ave. in St. Paul that he owned with his former wife. /ppIt's a matter of somebody getting way out of line with the authority they were given as a lawyer, said Douglas Elsass, attorney for CMB. /p

Thomas: Some questioning of Court 'irresponsible'

pQuestioning the Supreme Court and other government branches needs to stay within the range of fair criticism or run the risk in our society of undermining institutions that we need to preserve our liberties, Justice Clarence Thomas said Thursday. /ppThomas also told an audience at the University of Florida law school that some comments he hears about the court border on being irresponsible. /ppHe didn't speak specifically about the court's recent decision on campaign financing or mention President Barack Obama. But Thomas' comments come a week after Obama took the rare step of openly criticizing the decision during his State of the Union speech. /ppThomas supported the 5-4 ruling that allows companies and unions to spend freely on ads that promote or target candidates by name. /p


NY Court Rejects Dan Rather's Appeal Against CBS

pNew York's top court has rejected Dan Rather's bid to reinstate his $70 million breach-of-contract lawsuit against CBS Corp./ppRather's motion was denied without comment Tuesday by the Court of Appeals./ppCBS spokeswoman Shannon Jacobs says the network is pleased with the outcome. A call to Rather's lawyer was not immediately returned./ppRather sued CBS and its top executives in 2007, claiming he had been wrongfully removed from his CBS Evening News anchor post over a report that examined President George W. Bush's military service./ppIn September, a five-member Appellate Division panel unanimously concluded there was no breach of contract because CBS still paid Rather his $6 million annual salary after the disputed 2004 broadcast./p


Former Racine mayor pleads guilty in sex sting

Former Racine Mayor Gary Becker has pleaded guilty to two charges stemming from an Internet sex sting.pIn exchange, prosecutors agreed to dismiss six other charges during Tuesday's hearing./ppThe 52-year-old Becker pleaded guilty to attempted sexual assault of a child under 16 and child enticement. He faces up to 45 years in prison when he's sentenced March 3./ppDefense attorney Patrick Cafferty declined comment until after Becker's sentencing hearing./ppBecker was arrested at a shopping center on Jan. 13 in a sting operation after authorities said he was involved in explicit Internet chats with a state agent posing as a 14-year-old girl./ppBecker was charged Jan. 15 and resigned as mayor five days later./p
