Starbucks Sued over Unreasonably Hot Tea

pStarbucks Corp has been sued by a customer who allegedly suffered second-degree burns after being served tea that was too hot./ppAccording to the complaint, the plaintiff Zeynep Inanli was served tea that was unreasonably hot, in containers which were not safe, at a Starbucks store at 685 Third Avenue in Manhattan./ppAs a result of Starbucks' negligence, the plaintiff suffered great physical pain and mental anguish, including the burns, the complaint said./ppThe plaintiff seeks unspecified damages./ppStarbucks, based in Seattle, did not immediately return requests for comment. The plaintiff's lawyer did not immediately return a call for comment./ppRetailers periodically face lawsuits for serving beverages at temperatures that customers say are too high./ppIn one well-known case, a jury in 1994 ordered McDonald's Corp to pay $2.86 million to Stella Liebeck, an Albuquerque, New Mexico woman who claimed she scalded herself with the restaurant's coffee. The parties later settled./p


Justice questions way court nominees are grilled

The man considered the Supreme Court's swing vote is questioning the way some senators may grill the woman nominated to share the bench with him.pIn a speech in West Palm Beach on Friday, Justice Anthony Kennedy said lawmakers should not try to figure out how high court nominee Elena Kagan would rule on specific questions./ppHe said they should instead look at whether her temperament, commitment and character make her suitable for the job./ppKennedy declined to offer Kagan any advice. He joked that if you ask him what makes a good judge, you're going to get an autobiography./ppKagan, the nation's solicitor general, was tapped by President Barack Obama to succeed retiring Justice John Paul Stevens./p


PG being sued over Pampers Dry Max diapers

pProcter amp; Gamble Co is being sued by parents claiming new Pampers diapers have caused severe rashes and other skin conditions on their children, court documents showed, assertions the company has called completely false./ppThe action, filed by the law firm of Keller Rohrback, comes on the heels of parents' complaints that updated Pampers Swaddlers and Cruisers diapers with Pamp;G's new Dry Max technology appear to have caused rashes and burns on their children. A number of parents have voiced concern in Internet forums such as Facebook./ppWhile we have great empathy for any parent dealing with diaper rash - a common and sometimes severe condition - the claims made in this lawsuit are completely false, Pamp;G said in a statement. We have every confidence that we will prevail in this meritless lawsuit./ppAccording to documents, the lawsuit wants the court to require Pamp;G to ensure that Pampers will not cause severe rashes, blisters, welts, chemical burns and other skin ailments and to regularly test the product. It also wants parents to be reimbursed for the diapers and compensated for treatment of skin ailments in their children they say were caused by the diapers./ppLast week, Pampers dismissed reports that the diapers were causing skin irritations after the U.S. Consumer Product Safety Commission and Health Canada said they were investigating the products.

Still no mystery man ID in Ore. court appearance

An Oregon man accused of assuming the identity of a slain Ohio boy has refused to reveal his true name in his latest court appearance.
pFederal prosecutors say the man claiming to be Jason Robert Evers — the name of the dead boy — must be hiding something but he will not say what it is./ppHe is listed as John Doe in court documents, including the criminal complaint charging him with providing false information on a passport application leading to his arrest in Idaho last month./ppThe man has worked for the last eight years as an Oregon liquor control investigator, but has been placed on administrative leave pending the outcome of his case./ppHe was extradited from Idaho this week and made his initial appearance in federal court in Oregon on Thursday./p


NY court axes suit vs. label over Remy Ma shooting

A New York appeals court has rebuffed an attempt to hold Remy Ma's former record label accountable for the rapper's shooting of an acquaintance in 2007.pTuesday's ruling notes that a Universal Music Group Inc. affiliate ended its contract with Remy Ma nine months before she shot Makeda Barnes-Joseph outside a Manhattan nightclub./ppThe Grammy Award-nominated rapper was convicted of assault and other charges. She's serving an eight-year prison sentence./ppBarnes-Joseph's lawyer says she's disappointed by the ruling. A lawyer for Remy Ma had no immediate comment. A lawyer for Universal didn't immediately return a call./ppThe appeals court upheld a lower court's decision to dismiss Barnes-Joseph's case against Universal and various affiliates. She also is suing the rapper and the club./p


Manchester law firm advises on Midlands care home deals

JMW Solicitors has advised a care operator on its recent acquisition of two homes.

A team from the Manchester law firm, led by corporate partner Scott Sands and solicitor Vicky Protano, advised Central England Healthcare Ltd on its acquisition of The Old Vicarage in Stoke-on-Trent from private owners Mr and Mrs Kilby. The Old Vicarage is registered to provide nursing care for 45 service users and is rated excellent by the Care Quality Commission.

Richard Wolff, partner and head of corporate recovery and insolvency advised the same Midlands-based operator on its purchase, from the administrators, of Eversleigh Nursing Home in Wolverhampton. Registered to provide nursing care for 84 service users, this is the company’s largest acquisition.

Chris King, corporate partner at JMW advised Central England Healthcare in relation to the refinancing of the group and in relation to the financing of the two acquisitions.

Sands said: “It’s pleasing to see a company that can see real opportunities for growth even when the economic climate is still somewhat uncertain.”
